M.S. ANAND vs D.P. CHOPRA And OTHERS

THIS appeal has been filed by Shri M.S. Anand, allegedly ex-Managing Director of M/s. Anand Pratyabhoot Vit Nigam. The facts of the case are that seven decrees were obtained by Shri D.P. Chopra against M/s. Anand Pratyabhoot Vit Nigam and he made complaints u/Sec. 27 of the Consumer Protection Act against Mr. Anand. During trial Mr. Anand made an application before the Forum that he had resigned as a Managing Director and in order to prove the fact UCO Bank, South Patel Nagar, UCO Bank Arya Samaj Road and UCO Bank West Patel Nagar all situated at New Delhi in which they had filed certain resolutions, be summoned. The application of Mr. Anand was rejected by the Forum observing that he can inspect the records from the office of the Official Liquidator and obtain copies of the resolutions from there. He has come up in appeal against that order to the Commission.

WE have heard the learned Counsel for the Appellant and Mr. Chopra, Respondent in person. WE do not find any infirmity in the order. The original records are stated to be in the possession of the Official Liquidator. Shri Anand can inspect the records there and obtain copies from the Official Liquidator and produce before the Forum. There are no grounds to interfere with the impugned order. It appears that the application has been made in order to delay the proceedings. Consequently, we dismiss the appeal with costs. Costs Rs. 500/-. Stay order stands vacated. Appeal dismissed.
