The original petition is filed to direct the Court of the Munsiff, Chittur, to consider and dispose of E.A. No.74/2022 in E.P. No.144/2021, expeditiously.
Pursuant to the order dated 29.3.2023 passed by this Court, the learned Munsiff, Chittur, by communication dated 31.3.2023, has informed this Court that E.A. No.74/2022 is filed by a third party under Order 21 Rule 97 of the Code of Civil Procedure. E.A. stands posted for hearing to 21.6.2023. The court below requires three months time to dispose of the application.
Heard; Sri.P.B.Krishnan, the learned counsel appearing for the petitioner. Even though notice has been served on the counsel appearing for the respondents before the court below, there is no appearance for them.
In the light of the pleadings and materials on record and after perusing the communication of the learned Munsiff, in exercise of the supervisory powers of this Court under Article 227 of the Constitution of India, I direct the Court of the Munsiff, Chittur, to consider and dispose of E.A. No.74/2022 in E.P. No.144/2021, in accordance with law and as expeditiously as possible, at any rate, within a period of three months from the date of receipt of a certified copy of the judgment, excluding the time period for summer vacation.
The original petition is ordered accordingly.
