Judgment
(PER: HON'BLE MR. JUSTICE M.I.ARUN)
The petitioner herein was the petitioner in W.P.No.103154/2024. In the said writ petition, the learned Single Judge passed the following order:
“ORDER
(i)Petition is allowed.
(ii)Writ of mandamus is issued to respondents No.3 to 6 to consider the representation of the petitioner dated 24.11.2023 and pass appropriate suitable orders within a period of four months from the date of receipt of copy of this order by providing suitable opportunity and if required by taking help of ADLR for the purpose of survey.”
The present contempt petition has been filed alleging willful disobedience of the aforesaid order passed by the learned Single Judge.
The order passed by the learned Single Judge has also been assailed by the State in a writ appeal. On 18.08.2026, the following order came to be passed in the said writ appeal:
“Issue emergent notice to the respondent. The respondent shall not precipitate the matter till the next date of hearing.
I.A.No.1/2026 shall be heard along with the main matter.
I.A.No.2/2026 is allowed. The appellants are dispensed with production of English translations of the annexures mentioned in the application for the present.
I.A.No.3/2026 is allowed. The appellants are dispensed with production of typed copies of the annexures mentioned therein, subject to an undertaking that the typed copies shall be produced, if called upon by the Court, at the time of hearing.
Re-list the matter along with CCC No.100008/2026 on 28.09.2026.”
As the order passed by the learned Single Judge has been assailed by the State in the writ appeal and the respondents have been directed not to precipitate the matter during the pendency of the writ appeal, in our opinion, the present contempt petition is liable to be dismissed.
It is needless to state, if the petitioner were to succeed in the writ appeal, he would be at liberty to have the order passed in the writ appeal enforced in accordance with law.
For the aforementioned reasons, the contempt petition is dismissed.
