Judgment
I have heard the petitioner no. 3 in person who has challenged the entire complaint case being no. C-1426 of 2017 pending in the Court of the learned
Additional Chief Judicial Magistrate, Baruipur alleging offence under Sections 472/473/477A/195A/196/197/198/200/207/384/385/506/120B/34 C of
IPC being the G.R. Case No. 8687 of 2017 under Sections 419/420/467/468/506/34 of IPC along with added Sections 472/473/477A/509/120B of IPC
arising out of Sonarpur P.S. Case No. 2440 of 2017 dated 24.12.2017 overriding the cognizance/action taken by the learned Magistrate and
surmounting the Sections 155, 157 and 210 of Cr.P.C.
Let a copy of this application be served upon the opposite party no. 2 by speed post with acknowledgement due and a copy to the opposite party
no.1/office of the learned Public Prosecutor, High Court, Â Calcutta within one week from date with a direction to file an affidavit of service on the
date fixed.
List the matter on 9th of April, 2018.
Let there be an interim order of stay till 9th of April, 2018.
