Heard Shri Iftikhar Agha and Shri A. Kamat, learned Counsel appearing for the respective parties. During the course of the hearing of the above Petitions, the learned Counsel appearing for the respective parties have pointed out that the parties have amicably settled the dispute in the suit and that they have entered into consent terms duly signed by the parties alongwith their respective Advocates and pray that the learned Civil Judge, Senior Division, at Panaji, be directed to dispose of Special Civil Suit No. 69/2009/B in terms of the Consent Terms. Both the learned Counsel further pointed out that the impugned Orders in the present Petitions dated 09.03.2010 and 08.10.2010, be quashed and set aside by consent. The parties who are present in Court along with their respective Advocates, have accepted the Consent Terms and have stated that they have willingly signed the Consent Terms.

The Consent Terms are accepted and taken on record and marked ''X'' for identification. In view of the above, I pass the following :

ORDER

F.M. Reis, J

(i) The impugned Orders dated 09.03.2010 and 08.10.2010 are quashed and set aside by consent.

(ii) The learned Civil Judge, Senior Division at Panaji, is directed to dispose of Special Civil Suit No. 69/2009/B in terms of the Consent Terms marked ''X'' for identification and draw a decree accordingly.

(iii) Both the above Petitions stand disposed of in the above terms with no Orders as to costs.
