Judgment
Heard Ms. Pereira, learned Counsel appearing for the Petitioner, Mr. D. Lawande, learned Advocate general appearing for the Respondent nos.4 and 5 and Mr. Vivek Rodrigues, learned Counsel appearing for the Respondent no. 3.
Rule. Heard forthwith with the consent of the learned Counsel. Learned Counsel appearing for the Respondents, waive service.
During the course of the hearing of the above Appeal, Shri D. Lawande, learned Advocate General, states that the Appeal preferred by the Petitioner under Rule 87-A of the Goa School Education Rules 1986, which was subject matter of the decision impugned in the above Petition dated 22.02.2017, shall be heard and examined by the Respondent no. 4 afresh after giving a hearing to the Petitioner and other concerned parties within four weeks from today.
Accepting the said statement of the learned Advocate General, we dispose of the above Petition by quashing and setting aside the impugned decision dated 22.02.2017 and directing the Respondent no. 4 to decide the Appeal preferred by the Petitioner stated to be under Rule 87 A of the said Rules as expeditiously as possible payable within four weeks from today.
The parties are directed to appear before the Respondent no. 4 on 18.04.2017 at 3.30 p.m.
Rule is made absolute in the above terms.
