This Court notes that the Petitioner has been appointed in the year 1997 on a contract basis and thereafter was regularized in the year 2002. Petitioner’s claim for service benefits claimed in this Writ Petition except one below cannot be considered as the Petitioner slept over those rights for over a decade.

This Court notes that the Government by its order dated 18.05.2013 reckoned the qualifying service of the Petitioner for a purpose of pensionary benefits w.e.f. 18.02.1997 to 31.05.2002 ignoring certain gaps between 12.12.1998 to 18.02.2002. Then the Government by its order dated 07.07.2025 ordered annual increment @ 3% of the sum of the pay in the pay band plus grade pay in the relevant pay band of the scheme.

The Petitioner points out that there is a disparity in the pay scale of the Petitioner with others who had joined on the same date. In light of the fact that the Government had already considered her past services from the date of initial appointment as a contractual employee, it is appropriate for the Government to consider the Petitioner’s claim for annual increment in light of the Government order dated 18.05.2013.

The appropriate Order by the Government may be passed within a period of six weeks.

Nothing survives further in the matter. Accordingly, the Writ Petition stands disposed as above.
