While working in various posts under the 1st respondent, the petitioners 1 to 30 superannuated and the 31st petitioner resigned from service. The grievance of the petitioners is that they have not so far been disbursed the privilege leave encashment due to them. The petitioners have filed this writ petition for a direction to the respondents to disburse the privilege leave encashment due to them with 12% interest from the due date, within a time limit to be fixed by this Court.
Heard the learned counsel for the petitioner and the learned Standing Counsel for the respondents.
The petitioners have produced Ext.P4 judgment passed in identical circumstances and seek for relief in line with Ext.P4. The learned Standing Counsel submits that this writ petition can be disposed of in the light of the directions in Ext.P4 judgment.
In view of the submission, this writ petition is disposed with the following directions:
(a) There will be a direction to the respondents to disburse the privilege leave encashment due to the petitioners with statutory interest and disburse the same to the petitioners expeditiously, in any event, within a period of eight months from the date of receipt of a copy of this judgment.
(b) The petitioners shall produce a copy of the writ petition along with the judgment before the concerned respondent to ensure compliance.
