Heard Learned Counsel for the parties.
This appeal has been filed by the erstwhile 'Resolution Professional' challenging the order of the 'Adjudicating Authority' dated 06.10.2020 by which order, a 'Liquidator' has been appointed i.e. Respondent to this Appeal.
Aggrieved by the order of the 'Adjudicating Authority' not permitting the 'Resolution Professional' to continue as Liquidator and appointing the Respondent as Liquidator, the Appellant has come to this Court.
In paragraph 9 of the judgement, the reasons have been given by the 'Adjudicating Authority' for not continuing the 'Resolution Professional' as 'Liquidator'.
Learned Counsel appearing for the Respondent submits that he has already received communication for his appointment as 'Liquidator' and he has already published the public announcements and invited the claims and valuers have been appointed.
In view of the facts of the present case, we are not inclined to entertain this appeal. We, however, observe that observations made against the Appellant in paragraph- 8 and 9 shall not be taken any adverse observations, to attach any disqualification on the Appellant. The appeal is dismissed subject to above.
