Judgment
S.J. Kathawalla, J.—Heard the Learned Advocates appearing for the Parties. The following order is passed by consent:
i. The Suit is decreed in terms of prayer clauses (a) and (b).
ii. The Defendants shall pay costs of Rs. 10 Lacs.
iii. By consent of the parties, it is agreed that the said costs will be paid to charitable institutions as follows:
(a) Rs. 1,00,000/- to the Sona Sarovar Charitable Trust, Mumbai established for treatment and care of cancer patients.
(b) Rs. 1,00,000/- to the Bombay City Red Cross Blood Centre, working towards supplying free blood to patients suffering from Thalassemia Major, which is an incurable genetic blood disorder.
(c) Rs. 1,00,000/- to the Maharogi Seva Samiti which runs the project-ANANDWAN that is an Ashram and a community rehabilitation centre for leprosy patients and the disabled from downtrodden sections of society.
(d) Rs. 1,00,000/- to Ahura Support which works towards providing care including general support, welfare, medical relief, education and learning to differently-abled persons facing mental and physical challenges such as special children including with Downs Syndrome, spastic children and children suffering from learning disabilities.
(e) Rs. 1,00,000/- to The Association of Parents of Mentally Retarded Children which manages ADHAR, which is a lifetime shelter for mentally challenged adults, working for their life enrichment, protection and development.
(f) Rs. 1,00,000/- to the Society for the Education of the Crippled (Child & Adult) which works for the education and rehabilitation of children and adults with physical and multiple disabilities from a low economic group.
(g) Rs. 1,00,000/- to Ameya Palak Sanghatana, a charitable organization at Thane, which houses special children/individuals.
(h) Rs. 1,00,000/- to Aseema Charitable Trust, a Mumbai based non-governmental organization which provides education to children living on the streets, or in slums and in inhuman conditions.
(I) Rs. 1,00,000/- to Vatsalya Trust, a charitable organization dedicated to the care and rehabilitation of destitute children.
(j) Rs. 1,00,000/- to the Niramaya Health Foundation, working for child health issues in slums of Mumbai.
In view of the above, Defendants agree and undertake to donate within a period of four weeks, the said aggregate amount of Rs. 10,00,000/- (Rupees Ten Lacs only) in the manner hereinabove set out and to forthwith forward the copies of receipts issued by the respective charitable institutions/organizations to the Advocate for the Plaintiff. The undertaking is accepted.
The above Suit is, accordingly, disposed of. Refund of Court Fees, if any as per Rules.
