Judgment
The Learned Counsel for the Appellant would submit that present Chamber Appeal No. 06/2026 has been filed seeking restoration of Misc. Appeal Dy. No. 594/2025, which came to be dismissed as the minor objections raised by the Registry could not be removed within the stipulated time; that, the Waiver Application had already been heard and decided by the Learned Chairperson In-charge. He would further submit that since the Counsel for the Appellant is based at Ahmedabad, the objections could not be removed within time due to the physical distance involved and also submitted that, if the appeal is restored, the objections would be removed within two days.
Not objected by the Respondent.
Accordingly, Chamber Appeal No. 06/2026 is allowed and Misc. Appeal Dy. No. 594/2025 is restored to file. The objections shall be removed within two days, failing which the appeal shall stand dismissed without further reference to the Court.
List the matter on 03.06.2026 before Ld. Registrar.
