ORAL ORDER

The present petition has been filed seeking the following reliefs:

“i.

Issue a Writ of Certiorari or any other appropriate Writ, quashing or recalling any Look Out Circular or any other actions of Respondents No.1 and 2 initiated as per ANNEXURE-‘C1’, and ;

ii.

Pass any other orders or orders which this Hon’ble Court deems fit in the given facts and circumstances of the case in the interest of justice and equity.”

The learned counsel for the petitioners, on instructions, submits that after the filing of the petition, they have received an intimation that so far as concerns petitioner No.3 – Mr. Deepu Rajendra Rai and petitioner No.4 – Smt. Savita Devi, there is no Look-out Circular issued by the respondents against them. Thus, he contends that the prayer qua these petitioners is not being pressed.

The statement of the learned counsel for the petitioners is taken on record. Accordingly, this petition so far as concerns petitioners No.3 and 4 is not being pressed and stands dismissed.

The learned counsel for the petitioners seeks to rely upon a charge-sheet, as well as an order dated 20.08.2026 passed by the Jurisdictional Magistrate. It is contended that in the charge-sheet, while naming certain other accused, Petitioner No.1 - Mr. Rahul Sethi and petitioner No.2 – Mr. Akshay Kalra have not been named. It is further contended that the order dated 20.08.2026 sets this out in the following terms:

“Date: 20.08.2026 Charge Sheet submitted by the PI of Cyber Crime PS South East Division in Cr.No. 130/2026 for the offence P/U/S. 66(C), 66(D), 85 IT Act and 318(4), 319(2), 3(5), 61(2) of BNS. Added Sec: 85 IT Act and 3(5), 61(2) of BNS. Accused No-1 and 2 are on court Bail. Accused No-3 and 4 are on High court Bail. Accused No-5 and 6 are Absconding. True copy of FIR / Complaint are enclosed Charge sheet and connected papers are checked, copies of charge sheet herewith enclosed. Prays for an order to take the cognizance for the above offences against the accused No-1 to 6. For orders. I have Perused the Charge sheet and its enclosures. There are prima facie materials to proceed against the accused No-1 Prashantkumar @ Ajit, A2- Akash Gupta, A3-Smt. Savitha devi, A4-Deepu Rajendra Rai, A5-Reckoning Service Private LTD, A6-Quantum Logic Labs PVT LTD, shown in the charge sheet. Hence Cognizance taken for the offence P/U/S. 66(C), 66(D), 85 IT Act and 318(4), 319(2), 3(5), 61(2) of BNS. Added Sec: 85 IT Act and 3(5), 61(2) of BNS. Hence, the following order.

ORDER

Register the Case against accused No.1 to 6 in Register No. III for the offence P/U/S.66(C), 66(D), 85 IT Act and 318(4), 319(2), 3(5), 61(2) of BNS. Added Sec: 85 IT Act and 3(5), 61(2) of BNS. Issue summons to accused No.1 to 6 Call on: 05-09-2026.”

The learned AGA submits that given the order passed by the learned Magistrate, the State would be proceeding to recall the instructions given in the Look-out Circular and necessary steps would be taken for withdrawal of the Look-out Circular against the petitioner No.1 and petitioner No.2, within a period of three weeks from today.

The learned counsel for the petitioners submits that the petition can therefore be disposed of in view of the statement made by the learned AGA.

The petition is accordingly disposed of. In the event, the steps are not taken by the State within three weeks from today, the petitioner No.1 and petitioner No.2 are at liberty to revive this petition. All pending applications stand closed.
