Judgment
Savitri Ratho, J
This application under Section 439 of Cr.P.C. has been filed in connection with Colliery P.S. Case No. 432 of 2023 corresponding to C.T. (SLP) NDPS Case No. 24 of 2023 pending in the court of the learned Additional Special Judge, Talcher under Sections 21(b)/29 of the N.D.P.S. Act.
Ms. Gayatri Das, learned counsel prays for an adjournment on behalf of Ms. Aditi Hota, learned counsel for the petitioner.
The allegations in brief against the petitioner are that on 16.09.2023 at about 8.10 P.M. when the S.I. of Colliery Police Station on instructions of IIC, Colliery Police Station went to Handidhua, Talcher to verify the information received regarding selling of contraband brown sugar and found the petitioner and two other accused persons, namely, Jiyaul Hoque and Ajaya Birabarma standing near the Chalagarh conveyor line at Handidhua, Talcher to Angul road. They tried to ran away on seeing the Police but after being chased all them were caught and on search brown sugar was recovered from the pant pocket of Jiyaul Hoque.
In view of the allegations that the brown sugar has been recovered from the co-accused, prayer for adjournment is accepted.
List this matter on 10.11.2023 along with BLAPL No. 11181 of 2023 filed by the co-accused, Ajaya Birabarma.
Mr. D.K. Mishra, learned Additional Government Advocate is directed to obtain the criminal antecedents of the petitioner.
