Judgment
The petitioner is the accused in Crime No.12 of 2019 of Chittur Police Station, registered for the offence punishable under Section 20 (b) (ii) (B) of the Narcotic Drugs and Psychotropic Substances Act, 1985 (for short "the NDPS Act"), on the allegation that on 16.04.2019 at 7.00 p.m., the petitioner was found in possession of 1.850 kg of ganja in a private bus bearing registration No.KL-09-AD- 1777, in contravention of the provisions of the NDPS Act. 2. The petitioner was arrested from the spot and ever since he has been in custody.
The learned Public Prosecutor has no serious objection in allowing this application. It has been submitted by the learned 3Public Prosecutor that the petitioner is not involved in any other offence of similar nature. Considering the facts and circumstances of the case, including the fact that the petitioner is the first time offender, I am inclined to grant bail to the petitioner.
In the result, this application stands allowed and the petitioner shall be enlarged on bail on condition of the petitioner executing a bond for Rs.35,000/- (Rupees Thirty Five Thousand only) with two solvent sureties, each for the like sum to the satisfaction of the Jurisdictional Magistrate and subject to the following further conditions:
(i) The petitioner shall report before the Investigating Officer on every Monday between 9.00 a.m. and 11.00 a.m. for six months and thereafter, as and w4hen required by the Investigating Officer for interrogation.
(ii) The petitioner shall not intimidate or influence the witnesses or in any way tamper with the investigation.
(iii) The petitioner shall not get involved in any other offence during the pendency of this case.
