Judgment

By way of the instant writ petition, the writ petitioner who is stated to be the widow of the (L) Sudhendu Chowdhury, a freedom fighter is praying for cancellation of Patta being Periodic (Miadi) Patta No. 510, Dag No. 247 of Revenue Village: Nandirchar, Mouza No. VIII-3 Lot, issued in the name of the private respondent.
The grievance of the writ petitioner is that without her knowledge, the Patta which should have been recorded in her name, has surreptitiously been recorded in the name of the respondents No. 4 and 5.
Mr. D. Nandi, the learned counsel for the petitioner submits that the petitioner has been compelled to approach this Court as in spite of repeated representations made before the respondent No. 2, the same have evoked no response. The learned counsel has drawn the attention of this Court to the representations, which had been filed spanning from 2016 to 2019, including the representation, which has been made before the Deputy Commissioner, West Garo Hills, Tura.
Mr. S. Dey, the learned counsel for the respondent No. 1 and 2, before whom the representations are stated to be pending submits that there are no such representations in the records of the Chief Executive Member, and further submits that for cancellation of Patta, the Chief Executive Member is not the competent authority.
Heard the learned counsel for the parties and examined the materials on record.
Without going into the question as to whether the Chief Executive Member is the competent authority for adjudication of the matter, this Court deems it fit at this stage for the ends of justice, and as submitted that representations had been filed on many occasions, to allow the petitioner to prefer a fresh representation before the respondent No. 2. The respondent No. 2 shall then look into the matter and after affording adequate opportunity pass orders in accordance with law. The entire exercise should be completed within a period of 3(three) months from the date of presentation a copy of this order along with fresh copy of the representation.
With the above directions, this matter stands closed and is accordingly disposed of
