Judgment
N.C. Jain and B. Rai, JJ.—The petitioner''s examination of B.A. Part-II has already commenced. In the date-sheet the papers of History and Music (Instrumental) are scheduled for tomorrow i.e. 7.5.1996 at 2.00 P.M. The petitioner, unfortunately, has taken both the aforesaid subjects. By way of this petition, it has been prayed that another date be fixed for giving these two papers so that the petitioner''s one year does not go waste. Learned counsel for respondents No. 1 and 2 has submitted before us that combination of History and Music (Instrumental) is not permissible as per the prospectus, but as a special case, the petitioner would be permitted to appear in both the papers and this has been done on compassionate grounds. The arrangement as has been suggested by the Court is acceptable to the learned counsel for the parties. The arrangement is that the petitioner would appear in the paper of History at 2.00 P.M. on 7.5.1996 at the examination centre fixed and after that paper is over, she would appear in the paper of Music (Instrumental) at the same centre. The University-authorities is would make such an arrangement that the petitioner will not be allowed to go out of the examination hall after completion of the paper of History except for a period of 15 minutes which will be consumed by her by taking tea etc. and the same would be provided to her in the examination hall itself. Since the Supervisory staff will have to stay beyond 5.00 P.M. and that too only for gone candidate, the petitioner would deposit a sum of Rs. 1000/ with the Principal of the College for meeting out the over time expenses for the supervisory staff which will be paid to the members of the supervisory staff by the University.
With these observations, the present writ petition is disposed of.
A copy of this order be given dasti to the counsel for the petitioner free of costs for immediate compliances
