Mr. Bhattacharjee, learned advocate appearing for the petitioner submits that the petitioner took admission in Serampore College under the University

of Calcutta in the year 2009 and was registered on 25th February, 2010. She could not appear in the Part-I examination scheduled in the year 2010

due to her ailments. Thereafter, the petitioner took admission in Ananda Mohan College in the year 2011 with Botany (Hons.) but she was unable to

appear in the Part-I examination during the period from 2012 to 2016. In the year 2017, she filled up the Part-I examination form, appeared and passed

the said Part-I examination. Thereafter though she filled up the Part-II examination form in the year 2018, she was unable to appear again on health

ground. The petitioner thereafter submitted a representation on 4th September, 2018 to the Secretary, Council for Undergraduate Studies, University

of Calcutta with a prayer to allow her to appear in the B.Sc. Part-II examination in the year 2019. In the month of February, 2019 she submitted the

fees for appearing in the Part-II examination. However, she was not allowed to participate in the same. According to Mr. Bhattacharjee, as per the

University regulations a graduation course can be completed within ten years from the date of admission. The petitioner’s registration was granted

on 25th February, 2010 and as such there can be no bar to allow her to appear in the Part-II examination of 2020.

Mr. Bhattacharya, learned advocate appearing for the University submits that as per the regulations of the University, a candidate can complete Part-

I, II and III examinations within a total span of ten years from the date of registration. Her registration was in the academic session 2009 and the said

period of ten years has already expired.

The writ petition has been preferred in the month of January, 2020. Admittedly, the petitioner was registered in the academic session 2009. The period

of ten years, as provided under the regulation, has also expired in the year 2019. The petitioner has also not completed the Part-II examination.

In the said conspectus, this Court is unable to grant the relief, as prayed for by the petitioner, and the writ petition is, accordingly, dismissed.

There shall, however, be no order as to costs.
