Momin vs State of U.P.

S.C. Nigam, J.—Sri Akhtar Hussain has filed his appearance slip on behalf of the complainant. It may be taken on record.

Heard learned Counsel for the applicantaccused, Sri Akhtar Hussain, learned Counsel for the complainant, learned Additional Government Advocate for the State and perused the record.

The applicantaccused Momin has moved this application for bail in case crime No. 564 of 2007, under sections 498A and 316 I.P.C. and section 3/4 Dowry Prohibition Act, Police Station Mansoori, District Ghaziabad.

The applicantaccused is the nephew of the husband of victim. He has been assigned the role of catching the legs and pressing them while the victim was sleeping.

Considering all the facts and circumstances of the case, I find it to be fit case for bail.

Let the applicantaccused Momin be released on bail in case crime No. 564 of 2007, under sections 498A and 316 I.P.C. and section 3/4 Dowry Prohibition Act, Police Station Mansoori, District Ghaziabad on his executing a personal bond and two sureties each in the like amount to the satisfaction of the Court concerned.
