Judgment
Sathish Ninan, J.
The petitioner is faced with an ex parte decree for money. In execution of the decree, a bus belonging to the petitioner is attached. It is presently in court custody.
Learned counsel for the petitioner submits that the bus is one covered under a permit and that keeping it idle will not be in the interests of anybody. He further submits that the petitioner is willing to furnish security for the decree amount to the satisfaction of the execution court. He has filed E.A No.110 of 2023 (Ext P9) seeking release of the vehicle on Kachit. It is also pointed out that an application seeking to set aside the ex parte decree is pending.
Considering the entire facts and circumstances, it is ordered that E.A No.110 of 2023 shall be considered and appropriate orders passed after hearing the respondent – decree holder also with due consideration to the fact that the petitioner – judgment debtor is willing to offer sufficient security. Let orders be passed preferably on the same date.
