Judgment

This first application under Section 438 of Cr.P.C. has been filed for grant of anticipatory bail.
The applicants apprehend their arrest in connection with Crime No.154/2022 registered at Police Station Hazira, District Gwalior for offence under Sections 294, 327, 506, 427 and 34 of IPC.
The age of applicant No.2 Gaurav Singh Yadav has been shown about 16 years, thus, he is juvenile.
Accordingly, the application under Section 438 of Cr.P.C. filed by applicant No.2 Gaurav Singh Yadav is not maintainable.
So far as the allegations against applicant No.1 Mohit Singh Yadav are concerned, it is alleged that the applicant No.1 alongwith co-accused as well as juvenile demanded Rs.500/- for purchasing the liquor and when it was refused by the complainant, then he was dragged out of the car. He was beaten and an extensive damage was caused to the car. As per the police case diary, a total loss of Rs.1,00,000/- has been caused to the car.
Considering the allegations as well as the fact that an extensive damage was caused to the car, this Court is of the considered opinion that it is not a fit case for grant of anticipatory bail.
Accordingly, the application filed by applicant No.1 Mohit Singh Yadav is hereby dismissed.
