Judgment
The present bail application has been filed under Section 438 Cr.P.C. in connection with FIR No. 159/2020 registered at Police Station Malarna
Doonger, District Sawai Madhopur for the offence(s) under Sections 376, 306 of IPC and Sections 3, 4 of POCSO Act.
Learned counsel for the petitioner submits that the petitioner has been falsely implicated in this case. As per FIR, deceased has taken poison on
15.03.2020 but FIR was lodged on 23.06.2020. Delay in lodging the FIR has not been defined. Deceased was admitted in the hospital for treatment
but no statement was recorded at that time. So, the petitioner be enlarged on anticipatory bail.
Learned Public Prosecutor and counsel for the complainant have opposed the bail application.
Allegation levelled against the petitioner is that the petitioner was teacher in Gurukul Science Academy, Gangapur City. He had committed rape
several times to deceased and also taken nude photos and blackmailed her. Due to this, deceased had taken poison.
On account of gravity of offence, I am not inclined to grant the benefit of bail to the petitioner under Section 438 Cr.P.C.
Hence, the bail application stands dismissed.
