Judgment

In view of the reasons mentioned in the application, the same is allowed and the matter is preponed from 1.12.2021 and is taken on Board today itself.
The petitioner seeks issuance of direction to respondents No.1 to 3 to get the matter arising out of FIR No. 202, dated 26.9.2020, Police Station DLF Phase-1, District Gurugram, under Sections 25(1-B) (A), 27(B) of Arms Act and Section 147, 148, 307 IPC, investigated through some agency or by some senior officer and also for issuance of direction for arrest of accused No.4 to 11.
During the course of arguments, learned counsel for the petitioner pointed out that as on date out of the 8 accused who are arrayed as respondents No.4 to 11 only two i.e. respondent No.4-Manoj and respondent No.10-Mahender have been arrested by the police and that the others are still at large and that the police is not taking necessary steps for effecting their arrest. It has also been informed that challan already stand presented against respondents No.4 and 10.
In view of the aforestated position wherein investigation qua two of the accused already stand concluded and challan stand presented, this Court does not deem it appropriate to transfer the investigation to any other agency. However, respondent No.2-Commissioner of Police, Gurugram is directed to ensure that all the requisite steps are taken for effecting arrest of the accused who are still at large so that a supplementary report in terms of Section 173 Cr.P.C. is also filed qua them.
A copy of this order be conveyed to respondent No.2- Commissioner of Police, Gurugram, for necessary compliance.
