In the present writ petition, the petitioner has challenged the letter dated 15.07.2019 (Annexure P-6), whereby the claim of the petitioner for grant of benefit of selection grade and for counting the earlier service rendered by him as qualifying service for the purpose of retiral benefits, has been rejected.
Learned counsel appearing on behalf of the petitioner submits that a perusal of the letter dated 15.07.2019 (Annexure P-6) would show that the benefit of selection grade has been denied on the ground that the petitioner did not pass the departmental examination, which is stated to be a pre requisite qualification for the purpose of grant of selection grade.
Learned counsel further submits that in light of memo dated 05.06.1991 (Annexure P-7), there is no requirement of passing a departmental examination for the purpose of grant of selection grade.
Learned counsel, on instructions from the petitioner, submits that at this stage, petitioner will be satisfied if a direction is given to respondent to re-consider the case of the petitioner for grant of selection grade in light of memo dated 05.06.1991 (Annexure P-7), in a time bound manner.
Learned counsel for the respondent does not object to the prayer made by learned counsel for the petitioner.
In view of the above and without commenting upon the merits of the case, this petition is hereby disposed of with a direction to respondent to re-consider the case of petitioner for grant of selection grade in light of memo dated 05.06.1991 (Annexure P-7), within a period of 04 months from the date of receipt of certified copy of this order in accordance with law/regulations.
Pending application(s), if any, shall also stand(s) disposed of accordingly.
