Judgment

This petition was heard and reserved for order/judgment on 17.03.2022 giving two weeks’ time to Mr. D.S.Chouhan, learned counsel appearing for respondent Nos. 1 and 2 to produce the relevant record.
Mr. Chouhan, learned counsel for respondent Nos. 1 and 2 has failed to produce the record. However, while going through the minutes of the proceedings, it came to my notice that the private respondents i.e respondent Nos. 3 and 4, whose selection and promotion in the cadre of Assistant in the respondent-Company is under challenge in this petition, have not been served.
It appears that in terms of order dated 28.05.2016, notices were issued to respondent Nos. 3 and 4 under registered AD covers on 11.06.2016 but the same were not received back served or un-served. Registry has put up the requisite note, but no formal order, setting them ex parte has been passed by the Court.
Be that as it may, since the statutory period expired long back and nobody has turned up to appear for respondent Nos. 3 and 4, as such, respondent Nos. 3 and 4 are set ex parte.
Heard learned counsel for the parties and perused the material on record. Prima facie, a case for admission of the instant petition is made out.
Admit.
Issue post admission notice. Mr. Chouhan, learned counsel accept notice on behalf of respondent Nos. 1 and 2. Steps for service of respondent Nos. 3 and 4 shall be taken by the petitioner within two weeks. Subject to taking of steps within the said period, notices shall be issued to respondent Nos. 3 and 4, returnable within four weeks.
List on 9th May, 2022.
Mr. Chouhan, learned counsel appearing for respondent Nos. 1 and 2 shall file a detailed counter affidavit by the next date of hearing after giving advance copy to learned counsel for the petitioner. He shall also keep the record available for perusal of the Court.
