Hon''ble Mr. Justice Surya Kant 1. The petitioner''s son was allotted the retail outlet dealership by respondent No. 2-Company at Sadhaura, District Yamuna Nagar in the year 2005. The son of the petitioner has now completed his degree in Electrical Engineering from NIT, Kurukshetra and has been selected as an Assistant Engineer in the Uttar Haryana Bijli Vitram Nigam Limited. It is obvious that he cannot retain the dealership and has to surrender it for joining the Government Organization. The petitioner has applied to the respondent-Corporation for transfer of the retail outlet dealership in his favour so that his son is not required to surrender the same.

It appears that the petitioner''s claim though has been turned down by the respondents vide their reply dated 7.8.2010 (Annexure P-5) to the legal notice dated 15.7.2010 served on behalf of the petitioner, however, the petitioner''s grievance is that no `formal order'' rejecting his claim has been communication to him so far.

Having heard Learned Counsel for the petitioner and without expressing any views on the entitlement of the petitioner and also keeping in view the respondents'' view point as contained in their reply to the legal notice, no effective relief can be granted by this Court except to observe that the respondent-Company may consider the petitioner''s claim sympathetically as per its Policy and if he is not found eligible or entitled to, let the decision to this effect be communicated to him as early as possible and preferably within a period of one month from the date of receiving a certified copy of this order.
