The prayer in the present writ petition filed under Articles 226/227 of the Constitution of India is for quashing the impugned Condition No. 8 inserted in the appointment letter dated 17.12.2008 (Annexure P-3), whereby right for pension as such had been denied, in view of the policy of the State dated 12.01.2004.

In the reply filed on behalf of respondents No. 1 & 2, the plea taken is that the said condition has been withdrawn vide order dated 26.05.2016 (Annexure R-1/T) and the petitioners will be entitled to be considered for pension upon retirement under the rules existing on 01.01.1997, the date of their deemed appointment.

Counsel for the State has placed on record various communications, whereby the Pension Payment Orders have been issued in respect of respective Treasury Officers.

Counsel for the petitioner does not have any further instructions. Resultantly, it is apparent that the matter has become infructuous, in view of the relief having been granted.

The writ petition stands disposed of, accordingly.
