Mohd. Yaseen and Others vs State of Punjab

Mehtab S. Gill, J.—This is a petition u/s 482, Cr.P.C. for quashing FIR No. 178 dated 14.7.2004 registered under Sections 406 and 498A, IPC at Police Station, Malerkotla.

Learned Counsel for the petitioners has argued that as per the FIR, no specific role has been attributed to the petitioners. All the members of the family have been falsely roped in.

Learned Counsel for the State has argued that a demand of motorcycle Kawasaki Boxer, TV, refrigerator, gold ornaments weighing 12 tolas including silver ornaments and Rs. 2 lacs were made by the petitioners.

I have heard the learned Counsel for the petitioners and perused the petition with their assistance.

No specific allegation has been made against petitioner No. 4 Mohd. Zameel and petitioner No. 5 Hafiz, who are the brothers of petitioner No. 1 Mohd. Yaseen, the husband of the complainant. Similarly, no specific allegations of demand of dowry and ill-treatment have been made against petitioner No. 6 Zameela, petitioner No. 7 Nazia and petitioner No. 8 Soonina, who are the sisters of petitioner No. 1 Mohd. Yaseen.

FIR No. 178 dated 14.7.2004 registered under Sections 406 and 498A, IPC at Police Station, Malerkotla is quashed qua Mohd. Zameel son of Hazi Abdul Latif, Hafiz son of Hazi Abdul Latif Zameela wife of Mohd. Ashraf, Nazia wife of Mohd. Shehjad and Soonina wife of Mohd Yameen. All consequential proceedings against them are also set aside.

The petition for quashing is dismissed qua Mohd. Yaseen son of Hazi Abdul Latif, Hazi Abdul Latif son of Hazi Rehamdin and Hamida wife of Hazi Abdul Latif.

With the above direction, petition is disposed of.
