Applicant- Mohd. Saleem, who is in jail in connection with Crime No. 378 of 2010, relating to offence punishable under of I.P.C, Police Station Ranipur, District Hardwar, has sought his release on bail.

Deceased is said to have been killed inside reserved forest. The present applicant is a forest guard. He is not named in First Information Report, nor any specific role is assigned to him. There are cross F.I.Rs. of the incident, and one Sukhwant Singh a forest official has lodged cross F.I.R against the poachers relating to offence punishable u/s 307 of I.P.C., and some other offences. Co accused Monu and Satpal with similar role have already been directed to be released on bail. The applicant has no criminal history.

In the above circumstances, without expressing any opinion as to final merits of the case, this Court is of the view that the applicant deserves bail.

The Bail Application is allowed. Let the applicant-Mohd. Saleem, be released on bail on executing personal bond and furnishing two sureties, each of the like amount, to the satisfaction of the Chief Judicial Magistrate, Hardwar.
