Learned counsel for the petitioner submits that the Petitioner/Complainant has filed R.T No.7223/20019 under Section 138 of the Negotiable Instruments Act, 1881, which is pending before the Court of Shri Ajay Pratap Singh Yadav, Judicial Magistrate First Class, Bhopal and the Court is affording undue adjournments to the Accused to cross-examine the Complainant and the matter has already been adjourned on three occasions, therefore, the Trial Court be directed to expedite the trial and complete it within some reasonable time frame in terms of the directions issued by Hon'ble the Supreme Court In Reference Expeditious Trial of Cases under Section 138 of the Negotiable Instruments Act, 1881 2022 LiveLaw (SC) 508.
In view of the aforesaid, without expressing any opinion on the merits, this Miscellaneous Petition can be disposed of with a direction to the Judicial Magistrate First Class, Bhopal concerned to expedite the trial within a period of three months from the date of receipt of certified copy of the order being passed today without affording any undue adjournment(s) to any of the parties.
In above terms, this Miscellaneous Petition is disposed of.
