Judgment
Raj Mohan Singh, J
The case has been taken up for hearing through video conferencing.
Petitioner seeks grant of anticipatory bail under Section 438 Cr.P.C. in case bearing FIR No.103 dated 13.07.2020 under Section 420 IPC registered at Police Station City-I Malerkotla, District Sangrur.
Allegations are of sending the complainant to Japan on a forged visa showing his residence to be that of Bangalore. The complainant was stopped at Airport in Tokyo and was deported back to India.
Admittedly, an amount of Rs.3 lacs was transferred in the account of the petitioner and an amount of Rs.3 lacs was given to him in cash.
On 05.03.2021, learned counsel for the petitioner sought time to have instructions whether the petitioner is ready to pay an amount of Rs.6 lacs to the complainant without prejudice to his right in the trial.
Learned counsel for the petitioner submits that the petitioner is not interested in paying the aforesaid amount to the complainant.
In order to detect fraud, custodial interrogation of the petitioner is required.
DISMISSED.
Nothing observed hereinabove shall be taken to be a final opinion on the merits of the case.
