The applicant is accused No.2 in crime number 104/2001 registered in Gobara Navapara Police Station for the offence punshable u/s 34A of the M.P. Excise Act, 1915 (for short the Act).

It is submitted by the learned counsel for the applicant that accused No.1 Ramesh Sahu and Raju Sahu in the said crime has been released on bail by this Court by its order dated 17.01.2002. A copy of the said order passed by this Court has also been produced. It is clear from the said order that this Court released the said accused on bail on certain conditions.

Since the accused No. 1 himself has already been released on bail by this Court on having regard to the nature of the offence alleged against the applicant the applicant is also entitled for same relief.

Accordingly the petition is allowed. The applicant is directed to be released on bail on his execution a personal bond in sum of Rs. 50,000/- with two sureties to Rs. 25000/- each to the satisfaction of C.J.M. Raipur for his appearance before the said Court/trial Court on all dates of hearing so fixed by the Court. The bond shall contain photograph, crime number, details of movable and immovable properties belonging to the applicant. The applicant shall appear before the police station concerned on 1st and 3rd Sunday of every month between 2.00 P.M. to 4.00 P.M.
