M. Katju, J.—By means of this petition, the petitioner has prayed for a mandamus directing the respondent No. 1 to pay salary as trained teacher in B.TC. and to quash the impugned order dated 481992.

2.I have heard learned counsel for the parties and find no merit in this petition. The petitioner was appointed as untrained teacher in Vijai Laxmi Pandit Inter College, Phoolpur, Allahabad in the primary section. The petitioner has done his Intermediate and he has alleged that he got a training certificate from Rashtriya Patrachar Sansthan, Kanpur vide Annexure1 to the petition. The controversy in this case is whether the aforesaid training qualification is equivalent to B.T.C. The petitioner has alleged that this qualification is equivalent to B.T.C. and hence the should be granted trained teachers'' grade,

In the counter affidavit of the D.I.O.S. it has been stated in paragraph 4 that Rashtriya Patrachar Sansthan, Kanpur has not been recognised by the State Government and hence the aforesaid certificate cannot be treated as equivalent to B.TC. However, a counter affidavit has been filed by the Manager of the Rashtriya Patrachar Sansthan, Kanpur and it has been alleged that in some enquiry held by the M.R.TP. Commission, certificates issued by the Rashtriya Pmrachar Sansthan are legal vide Annexure1 to the said counter affidavit which is copy of the report of the Director General of Investigation and Registrar, M. R. T. P. Commission dated 9.10.1992.

In my opinion the M. R. T. P. Commission has nothing to do in this matter. It is for the State Government to grant recognition to the Rashtriya Patrachar Sansthan or not. Since the State Government has not granted recognition to the said Sansthan, I am of the opinion that the said certificate granted by the Rashtriya Patrachar Sansthan cannot be treated as equivalent to B.T.C. It is for the State Government to grant equivalent or not and not for this Court or any other authority.

The petition is dismissed.
