Mohd. Hasan Alvi vs The State Of U.P. and Another

Vishnu Chandra Gupta, J.—The petitioner seeks parity of order dated 21.12.2012 passed by this Court in Criminal Misc. Case No. 5735 of 2012 (U/s. Cr. P.C.). In view of the said order the same relief is granted to the present petitioner also. Heard learned counsel for the petitioner and learned A.G.A. for the State. This is a petition u/s 482 Cr. P.C. for quashing the charge-sheet dated 30.8.2012 in Case Crime No. 1843 of 2012, under Sections, 420, 467, 468, 471, 120-B, I.P.C., P.S. Kakori, District Lucknow.

Learned counsel for the petitioner has not argued the case on merits, but, has submitted that the petitioner is willing to surrender in the concerned court and their bail application may be directed to be disposed of expeditiously and in the mean time some protection may be provided to him.

However, if petitioner, namely, Mohd. Hasan Alvi, surrenders before the court below within one month from today and moves bail application, the same shall be considered and disposed of expeditiously in accordance with law and also keeping in view the directions contained in the judgement delivered by the Apex Court reported in Lal Kamlendra Pratap Singh Vs. State of U.P. and Others, .

For one month or till the date of surrender, whichever is earlier, no coercive steps shall be taken against the petitioner. With the aforesaid observation/direction, this petition is finally disposed of.
