Judgment
Kurian Joseph, C.J.—The writ petition is filed with the following prayers:
a) That a writ in the nature of mandamus may very kindly be issued to the Respondents to make a permanent solution for offering prayers (Namaz) on the occasion of Id-Festival which normally be conducted for 2-3 hours or so without any hindrance in Military ground at Nahan which playground is being used for the last more than 65 years without any interruption or hindrance to keep harmonious relations in the entire Society.
b) That the Respondent more particularly the Central Government of India may kindly be directed to interfere in the matter and make some strict guidelines/permanent written consent/agreement/understanding with the authorities who are making hurdles in the prayer and intervene in the matter forthwith and stop the persons/officers/officials/Government or any particular community which is not permissible under the law of Land.
c) That the State Government may also kindly be directed to ensure that prayer (Namaz) and permission the peace loving Muslim Community to promote permanent peaceful and harmonious relations.
d) Direct the State and Centre Government to take coercive action against the Officers/Officials or any other persons who are making hindrances in offering prayer (Namaz) in Military Ground, Nahan.
Learned Counsel for the Petitioner submits that in light of the reply furnished by the second, third and fourth Respondents that on security reasons their 2 ground cannot be made available, the Petitioner has now moved a representation before the fifth Respondent for appropriate steps for offering the Id prayers. There will be a direction to the fifth Respondent to look into the representation filed by thePetitioner and take appropriate action in accordance with law, most expeditiously, in any case, within one week from the date of production of a copy of this judgment by thePetitioner.
With the above direction, the writ petition stands disposed of, so also the pending application (s), if any. Authenticated copy of this judgment be supplied to the parties.
