Judgment
The accused/applicant, suffering incarceration since 13.10.2024, seeks regular bail in case FIR No. 669/2024 of PS Nand Nagri for offence under Section 109(1) of BNS and 25/27 Arms Act.
Broadly speaking, the allegation against the accused/applicant is that he inflicted three knife blows on the injured complainant de facto.
It is contended by learned counsel for accused/applicant and affirmed by the IO/SI Ashish Sharma that the injured complainant de facto in his testimony has not supported prosecution case. However, learned prosecutor submits that there is one eye witness and neighbour Rehan also who is yet to depose. But Rihan is not named in the FIR showing his presence at the time of incident. It is informed by the IO that the injured got discharged from the hospital on 15.10.2024, i.e., after three days of the alleged incident.
Considering the above circumstances, the application is allowed and accused/applicant is directed to be released on bail subject to his furnishing a personal bond in the sum of Rs.10,000/- with one surety in the like amount to the satisfaction of the Trial Court. Accompanying application also stands disposed of.
A copy of this order be immediately transmitted to the concerned Jail Superintendent for informing the accused/applicant.
