Mohan Singh and Another vs Chuhar Singh and Another

S.S. Sodhi, J.—The challenge here is to the award of Rs. 20,000/- as compensation to the father Chuhar Singh for the loss suffered by him

on account of the death of his son Amrik Singh who was killed in an accident with a truck.

The facts relevant to this matter are that Amrik Singh deceased, who was teacher in the Government Primary School, Dhunda, was on his way

to the school when he was run over and killed by the truck PUE 5947.

It was the finding of the Tribunal that this accident bad been caused entirely due to the rash and negligent driving of the truck driver and the

claimant Chuhar Singh, his father, was accordingly awarded Rs. 20,000/- as compensation.

The only point sought to be raised in appeal was with regard to the quantum of compensation awarded to the claimant. It is no doubt true that

the claimant Chuhar Singh was 65 years of age when his son Amrik Singh was killed in this accident, but it is an admitted fact that the claimant is

still alive and is said to be in good health. Amrik Singh deceased was only 23 years of age at the time of his death and as has been mentioned

earlier, he was a teacher in the Government Primary School. It has come to record that his salary was over Rs. 560/- per month. Keeping in view

the circumstances of the claimant and the situation of the deceased, no exception can be taken to the award of Rs. 20,000/- as compensation to

the father of the deceased.

This appeal is consequently hereby dismissed with costs. Counsel''s fee Rs. 300/-.
