This criminal revision petition has been filed by the petitioner being aggrieved with the order dated 19.7.2018 passed by Sessions Judge, Sirohi whereby application filed by the petitioner under Section 408 I.P.C. with a prayer to transfer the criminal proceedings pending between him and his wife in the court of Judicial Magistrate Revdar to any other court of District Sirohi has been rejected. The allegation has been levelled in the application that the Presiding Officer is biased, therefore, the matters pending before his court may be transferred to some other court.
The learned Sessions Judge, Sirohi after taking into consideration the arguments advanced by counsel for the parties has rejected the application while observing that no justifiable reason exists to grant prayer of the petitioner.
Having heard learned counsel for the petitioner and having gone through the impugned order, I do not find any illegality. Hence, this criminal revision petition is dismissed. The stay petition is also dismissed.
