Instant bail application on behalf of petitioners is filed under Section 439 Cr.P.C., arising out of an excise case registered against the petitioners in which they are charged for offence punishable under Sections 16/54 & 54D of the Rajasthan Excise Act.

Learned counsel for the petitioners submits that offence alleged against petitioners is triable by Magistrate and trial will take long time to conclude, therefore, petitioners may be enlarged on bail.

Learned Public Prosecutor has opposed the bail application. Having heard learned counsel for the parties and considering totality of facts and circumstances of the case, without expressing  any opinion on merits of the case, I deem it just and appropriate to grant indulgence to the petitioners by enlarging them on bail.

Accordingly, the bail application under Section 439 Cr.P.C. is allowed and it is ordered that accused-petitioners (1) Mohan Lal S/o Shri Roop Lal, and (2) Ratan Lal @ Pintu S/o Daulat Ram, arrested in connection with F.I.R. No.18/2020-21, Police Station Excise Circle Mavli, District Udaipur, may be released on bail; provided each one of them furnishes a personal bond of Rs.50,000/- with two surety bonds of Rs.25,000/- each to the satisfaction of the learned trial Court with the stipulation to appear before that Court on all dates of hearing and as and when called upon to do so.
