WPSS No. 140 of 2013 filed by the petitioner was disposed of with a direction to the Conservator of Forest to consider petitioner's claim for appointment in the light of letter dated 15.04.2011 issued by Divisional Forest Officer, Haldwani.
A compliance affidavit has been filed by Mr. Chandra Shekhar Sanwal, Divisional Forest Officer, Forest Division, Haldwani Tikonia Forest Campus, Haldwani, District Nainital. Annexure -CA2 to the said compliance affidavit is an order passed by Chief Conservator of Forest on 19.01.2018. Perusal of the said order indicates that petitioner's claim for appointment was considered and rejected.
Since the only direction issued by Writ Court was to consider petitioner's claim for appointment, which has now been considered, therefore, in the considered opinion of this Court, nothing survives in this contempt petition.
Accordingly, the contempt petition is closed. Notice issued to the opposite party is hereby discharged. However, petitioner shall be at liberty to challenge the rejection order dated 19.01.2018 passed by Principal Chief Conservator of Forest before the appropriate forum.
