Judgment
C.R. Kumaraswamy, J.—Sri. T. Menorah, learned Counsel, files power on behalf of Respondent No. 2. The same is taken on record.
Petitioners 1 to 7 and their counsel are present before the Court. Respondent No. 2 and her counsel are alse present. Joint Memo dated 16.12.2010 is filed. Execution of the Joint Memo is admitted by the parties. The Joint Memo reads as under:
The Petitioners and the 2nd Respondent submits as follows:
That, the 2nd Respondent is the wife of the 7th Petitioner and the other Petitioners are in laws of the 2nd Respondent.
The Petitioners and the 2nd Respondent submits that, due to intervention of the elders and well wishers of the family, in order to put an end to the litigations they have amicably settled the issues between them accordingly the 2nd Respondent hereby withdraws the allegations made by her in her complaint unconditionally.
It is submitted that the Smt. Fouzia Khanam the wife of the 7th Petitioner and Daughter-in-law of the 1st Petitioner herein is leading her marital life peacefully by withdrawing her case.
It is most respectfully submitted that in view of the settlement arrived at between the parties, the criminal case registered by the 2nd Respondent is liable to be quashed.
Wherefore, the Petitioners and 2nd Respondent prays that this Hon''ble Court may be pleased to quash the entire proceedings in Crime No. 171/2010, Kalasipalyam Police Station in C.C. No. 41112/2010 pending before the learned 8th Additional Chief Metropolitan Magistrate at Bangalore.
Learned High Court Government Pleader submits that suitable orders may be passed.
The dispute is between Petitioner No. 7 and Respondent No. 2, who are husband and wife. At the intervention of the elders, the dispute between them has been settled amicably and they are living peacefully. In order to encourage the settlement of matrimonial dispute, this Criminal Petition deserves to be allowed.
In the result, I pass the following:
This Criminal Petition is allowed in terms of the Joint Memo dated 16.12.2010. Consequently, Crime No. 171/2010 of Kalasipalyam Police Station, which after investigation C.C. 41112/2010 was registered and is pending on the file of VIII ACMM, Bangalore, and this C.C. 41112/2010 is hereby quashed.
