Judgment

Present application is filed by the convict through jail seeking temporary bail on the ground to help out the family members in this period of crisis.
Heard Mr. J.K. Shah, learned Additional Public Prosecutor for the respondent â€" State.
Having considered the contents of the application, it has been pointed out by the learned Additional Public Prosecutor that the applicant is arraigned in
a serious offence punishable under Sections 377, 376(2)(i), 506(2) of the Indian Penal Code and under POSCO Act.
Having heard Mr. Shah, learned Additional Public Prosecutor, the reason which has been assigned for seeking temporary bail is found to be not
satisfactory, more particularly, in view of the fact that the applicant is arraigned in a serious offence and as per the information which has been passed
on by learned Public Prosecutor, that though having five children, the applicant, who is aged about 52 years, has committed this serious offence.
Hence, this is not a fit case in which the discretion is to be exercised. The present application stands rejected.
The Registry is directed to communicate this order by fax or e-mail to the jail authority.
