Mr. Mufti Javeed Ahmad, learned counsel for the petitioners has produced a notice issued by J&K Small Scale Industries Development Corporation Ltd. (SICOP), Sanat Ghar Bemina, Srinagar. The notice so produced is taken on record. The said notice was published in a daily newspaper, namely, 'Greater Kashmir' in its issue dated 28.02.2020 for the information of general public. It is contended in the notice that the applications received through online mode in respect of allotment of land in Industrial Estate, Zainakote vide communication No.SICOP/MD/LA/383 dated 12.10.2019, are revoked due to non-availability of internet facility in Kashmir Valley. It is also contended that fresh date for receipt of applications through online mode will be notified in due course of time.

A perusal of the notice reveals that the notice impugned challenged by the petitioners is withdrawn by the respondents-authority i.e., the J&K Small Scale Industries Development Corporation Ltd. (SICOP), Sanat Ghar Bemina, Srinagar.

In view of issuance of aforesaid notice, this petition has been rendered infructuous and nothing remains in this petition to adjudicate.

At this stage, learned counsel for the petitioners submits that the petitioners may be permitted to response if any fresh notice for allotment of land in Industrial Estate, Zainakote is issued. Prayer made is allowed.

Accordingly, this petition is, dismissed along with connected application, as having been rendered infructuous. However, the respondents particularly, respondent Nos. 2 and 3 are directed to accept and consider the applications of the petitioners as and when the notice for allotment of land is issued afresh, provided they are fully eligible. The petitioners shall be at liberty to respond to the fresh notice in the event it is re-advertised for allotment of land in Industrial Estate, Zainakote.
