Judgment

Heard Ms. C. Collasso, learned Counsel for the applicant and Mr. S.G. Bhobe, learned Public Prosecutor for the respondents.
Present application is filed for suspension of sentence and for grant of bail. It appears that the appellant was convicted by the Additional Sessions Judge, Mapusa in Special Criminal Case No.28/2017 for having committed offence under Section 20(b) (ii)(B) of the NDPS Act. He was sentenced to rigorous imprisonment for a period of one year and fine Rs.1.00 lakh.
The appeal is admitted. The appellant was on bail during the trial and he has not jumped out any condition of bail. In view thereof, the application is required to be allowed and accused be released on bail.
Accordingly, I pass the following order :
ORDER
(a) Judgment dated 02.12.2021 and 07.12.2021 passed by the Additional Sessions Judge, Mapusa, Goa in Special Criminal Case No.28/2017 is hereby suspended, subject to deposit of fine amount of Rs 1.00 lakh.
(b) The accused shall be released on bail on his furnishing PR bond of the amount of Rs. 25,000/- and one local surety in co-extensive amount to the satisfaction of the trial Court.
(c) He shall not leave the State of Goa and the territorial waters of India without the prior written permission of this Court and under intimation to the I.O.
(d) He shall attend this Court at the time of final hearing of the appeal.
Application stands disposed of.
