The grievance of the petitioner is that his pending application under Section 68(2) of the Waqf Act, 1995 is not being decided by the respondent No. 2-Sub-Divisional Officer (Revenue), Mandsaur.
It is submitted that the petitioner was appointed as Chairperson of Mandsaur Waqf Masjid Gangi Khanpura and District Mandsaur Administrative Committee along with the other members. The said order was challenged before the Tribunal and the Tribunal dismissed the appeal against the said order. The said order was also challenged before this Court in Civil Revision No. 643/2022. The said revision was also dismissed and the order of appointment of the petitioner has been affirmed. Thus, the order of appointment of the petitioner and its committee has been affirmed by this Court also, but despite that the charge of the committee is not being handed over to him. Therefore, he filed an application under Section 68(2) of the Waqf Act, 1995, but the same is not being decided by the respondent No. 2.
Considering the grievance of the petitioner, I deem it expedient to dispose off the petition with a direction to the respondent No. 2 to consider and decide the pending application of the petitioner under Section 68(2) of the Waqf Act, 1995 within a period of one month from the date of receipt of the application in accordance with the law. If there is no legal impediment, the charge of the committee shall be handed over to the petitioner.
With the aforesaid, the petition is disposed off.
