Judgment
Narendra Kumar Jain I, J.—Heard the learned Counsel for Petitioner.
It is contended on behalf of Petitioner that Petitioner was given admission in B.Ed. Course in the year 2007-2008, he was declared pass in theory papers, but in practical examination, he was declared fail, thereafter he could not give practical examination due to poor financial condition, in these circumstances, he has preferred this writ petition to issue an appropriate writ, order or direction to Respondents to allow the Petitioner to appear in practical examination of B.Ed. Course.
During the course of arguments, the learned Counsel for Petitioner submitted that Petitioner may be permitted to withdraw this writ petition with liberty to file a representation before the Respondents for the same relief, which has been prayed in this writ petition, and the Respondents may be directed to consider his representation, sympathetically, in accordance with law within a reasonable period.
Consequently, the writ petition is dismissed as withdrawn with liberty, as prayed for.
It is directed that in case Petitioner files a representation before the Respondents, then the same will be considered, sympathetically, and decide the same, in accordance with law, within fifteen days.
Since the writ petition itself has been dismissed, therefore, this stay application does not survive and the same also stands dismissed.
