Heard learned counsel for the petitioner and learned Standing Counsel and with their consent, this petition is being finally disposed off.
It is pleaded that Rafi Mohammad Inter College in district Siddharth Nagar is a duly recognised and aided institution where the post of clerk fell vacant on the retirement of the incumbent on 31.5.2008. The District Inspector of Schools vide his letter dated 2.6.2008 granted permission to the management to proceed to fill up the vacancy in accordance to law whereupon after due advertisement in two daily newspapers, a Selection Committee consisting of several persons including the nominee of the District Inspector of Schools was constituted and after interview etc., the name of the petitioner was recommended and the management forwarded all the relevant papers to the District Inspector of Schools through covering letter dated 23.6.2008 for purposes of grant of approval which is still pending though the petitioner has been appointed.
If the aforesaid facts are correct, the petitioner may approach the District Inspector of Schools, Siddharth Nagar through a representation annexing all the relevant documents, who will take a reasoned decision after hearing the petitioner and the management within a period of six weeks from the date of submission of a self attested copy of the writ petition and a certified copy of this order.
It is clarified that the Court has not examined the merits of the claim of the petitioner.
