Judgment
G.Ilangovan, J
The petitioner/Sole Accused, who was arrested on 19.05.2022 for the alleged offence under Section 328 of IPC and Sections 417 & 376 of IPC, in Crime No.26 of 2022, on the file of the respondent police, seeks bail.
2.The case of the prosecution is that the petitioner had sexual intercourse with the defacto complainant by giving a false promise that he will marry her. Later refused to marry her. Hence, the case.
3.After hearing the learned counsel for the petitioner, learned counsel for the Intervener and learned Government Advocate (Crl.Side), interim bail is granted to the petitioner for 5 days only since the petitioner is going to write exam on 29.06.2022 (tomorrow) and 02.07.2022.
4.However, the learned counsel for the Intervener would submit that because of the lack of attendance, automatically, he lost his right to sit for exam. But, the concerned college may take care.
5.Since the petitioner is going to write exam, this Court is inclined to grant interim bail to the petitioner till 03.07.2022.
6.Accordingly, the petitioner is granted interim bail on condition that the petitioner shall execute a own bond for a sum of Rs.10,000/- (Rupees ten thousand only) to the satisfaction of the Superintendent of Central Prison, Madurai.
7.The petitioner shall surrender before the authorities on or before 05.00 p.m on 03.07.2022.
8.Call this case on 04.07.2022.
