The petitioner participated in an e-tender / e-auction held by the respondent-Department for excavation of river-bed material from 1.403 hectares of land at Village Dabhaura, Tehsil Kashipur, District Udham Singh Nagar. As his bid was found to be the highest, he is stated to have deposited, in all, a sum of Rs. 56,59,460/- so far. According to the petitioner, however, the site could not be demarcated due to change of course of river Kosi and the petitioner had not excavated any mineral from the river-bed. He applied for refund of the amount and the last representation, in this regard, was made on 24.03.2026 (Annexure No. 15).

Since the amount has not been refunded so far, the present writ petition has been filed.

Learned Deputy Advocate General for the State of Uttarakhand states that the matter is pending consideration before the State Government.

In view of the above, the writ petition is disposed of with direction to respondent No. 1 to take decision with regard to the refund of the amount on basis of the representation of the petitioner dated 24.03.2026 within a period of four weeks from the date of communication of the instant order, along with a photocopy of the representation.

All pending applications stand disposed of accordingly.
