THIS is a complaint made by the complainant who happens to be the General Secretary of the Southern Railway Mazdoor Union. His grievance is that his phone has not been properly functioning from 11.6.92. According to him it has been playing truant almost daily with the result that he could not receive calls regularly or hear calls on account of humming noises. He has made several representations, but rectifications are not effected. He has therefore come forward with a claim for compensation, damages and pecuniary loss at Rs. 8 lakhs.

THE Department resisted the claim and saying that the complainant''s phone is attended to as and when complaints were made and the phone is not now suffering from any defect. 3.THE learned Counsel for the complainant Mr. Ebrahim concedes that the phone is now working properly but there is no guarantee that it will continue to work. THE Counsel for the opposite party, Department made an undertaking to set right the fault as and when it occurs as expeditiously as possible. In the circumstances we pass the following order: 4. THE Department shall see that this phone works perfectly and any fault brought to the notice of the Department is attended to forthwith. THE Department shall also treat this phone as a V.I.P.'' s and check its proper functioning once in a fortnight. With this observation we dismiss the complaint. No costs. Complaint dismissed. ________________
