Mohan Shantanagoudar

1.

Notice to respondent No. 2 is dispensed with.

Heard the petitioner''s counsel and the learned Government Advocate for respondents 1, 3 and 4.

2.

The grievance of the petitioner is that respondents 1 and 4 are not considering the representations at Annexures-B and C, dated 16.5.2011 and 9.7.2011, respectively filed by the petitioner for initiating action against the persons who are running an industry in a non-converted land. Thus, this writ petition is filed praying for a direction to respondents 1 and 4 to consider the aforesaid representations.

3.

According to the petitioner, his brothers have set up an industry in a non-converted land. The petitioner has filed a suit in O.S.No.38/2006 before the Senior Civil Judge at Mysore, against his own mother and his brothers for partition and separate possession. The said suit is still pending consideration. It was open for the petitioner to seek interim orders in the very suit.

Be that as it may, since the petitioner has made representations as per Annexures-B and C, the same shall be considered by respondents 1 and 4 in accordance with law, after due notice to all the persons including the mother and the brothers of the petitioner.

With the aforesaid observations, the writ petition is disposed of.
